NOTICE IS HEREBY GIVEN
that the Buckley City Council will conduct a public hearing at their
October 10, 2006 Regular meeting, beginning at 7:00 p.m., to discuss:
Initiative 933, The Property Fairness Initiative
Ballot Measure Summary
This measure would require government
agencies to consider the effects of and alternatives to regulating
private property. Compensation would be required when regulations are
enforced that damage private property use or value, including
regulations prohibiting or restricting property uses that were allowed
as of January 1, 1996. Exceptions would exist for regulations applying
equally to all property subject to the agencys jurisdiction.
Development regulations that would prohibit existing legal property uses
would not be permitted.
RCW 42.17.130 prohibits City employees and elected officials from using
public facilities, directly or indirectly, to propose or oppose a
candidate or ballot measure. The City Council may take action at
an open public meeting in support of or in opposition to a candidate or
ballot measure as long as
(b) members of the legislative body or
members of the public are offered an approximately equal opportunity for
the expression of an opposing view.
This is not a debate and debate will
not be allowed. This is an informational session only. The public is
invited and encouraged to voice approval or disapproval on the issue.

27914 HINKLEMAN ROAD (STRIPMASTERS)
FRONTAGE STANDARD DESIGN MODIFICATION
Date:
August 31, 2006
Deferral Request:
: Applicant has submitted application to construct a new 9,750
sq ft commercial building with subsequent improvements at the property
located at 27914 Hinkleman Road. Subsequent improvements consist of
remodel/conversion of the existing single-family residence into a main
business office, installation of off-street parking, water main and
hydrant to meet fire flow and landscaping. Redevelopment and land
division of the property requires that the applicant install frontage
improvements to Hinkleman Road consistent with BMC 17.08.010 (4.07).
Applicant requested that the
City Council grant a modification from the full frontage requirement
that includes curb, gutter, sidewalk, planter strip, lighting, storm
drainage and ½ street widening to a standard 2 overlay of the existing
roadway from Mundy Loss to the eastern boundary of the applicants
property. In addition the applicant is requesting that a modification
be allowed from the permitted driveway width of 24 as specified in BMC
17.08.010 (4.11C) to 60.

Decision:
At a regular scheduled meeting on August 29, 2006, the Buckley City
Council did review the request and determine that the design
modification request did meet the review criteria subject to the
recommended conditions of approval identified in the staff advisory
report. Therefore the City Council granted approval to the design
modification request based on satisfactory compliance with the
recommended conditions of approval listed below.

PROPOSAL: Stripmasters Commercial Site Plan S-2006-01: Applicant is
proposing to construct a 9750 square foot building on the parcel located

improvements. The permit application proposes to install less than 5000
square feet of new impervious area (the site is currently partially
developed). The project proposes to widen an existing driveway for a
temporary construction entrance and future permanent driveway and
install sedimentation and erosion control measures to minimize sediment

Deferral Request:
The Applicant is proposing to construct a new 15,242 square foot office
building with subsequent improvements on the parcel located at 28719 -
SR410 (currently Pierce County tax parcel #5665000433) and is requesting
that the City Council grant a waiver or modification from the 196 of
frontage improvements required pursuant to BMC 17.08.050 and BMC
17.08.010 (4.07.A).
Site Location:
Subject property is located at 28719 - SR410 East which consists of lot
56 of McHugh Tracts according to Book 8 of Plats at page 100 records of
Pierce County, Washington, which is within a portion of Section 4,
Township 19N, Range 6E, W.M., Buckley, Washington as amended by lot line
adjustment.
Decision:
At a regular scheduled meeting on June 27, 2006 the Buckley City Council
did review the request and determine that a partial waiver was warranted
and therefore granted a partial waiver subject to demonstrated
compliance with six (6) conditions identified in the staff advisory
report.
This
decision was issued after a determination was made that once
satisfactory compliance with the recommended conditions of approval had
been demonstrated the granting of a partial waiver would satisfy the
variance criteria from BMC 17.08.010, Section 2.02A, Development
Guidelines and Public Works Standards.
Conditions of Approval:
Applicant
shall be required to comply with the following:
1.
Improve/rehabilitate
the stormwater drainage ditch to a well constructed, aesthetically
pleasing, vegetated drainage swale designed to meet minimum storm
requirements; and
2.
Install a shared
highway access to adopted highway design standards; and
3.
Install a meandering
6 wide sidewalk per Appendix 6E of the 2005 City Comprehensive Plan
Transportation Element; and
4.
Install landscaping as
approved by the planning department; and
5.
Install approved
street lighting; and
6.
The applicant shall
sign a waiver of protest in a Local Improvement District (L.I.D.) or
Utility Local Improvement District (U.L.I.D).

MAIN STREET RECONSTRUCTION AND CLOSURE
NOTICE IS HEREBY GIVEN that Main Street will be closed
to all traffic from River Avenue east to A Street beginning July 5,
2006. The street closure is necessary to complete the 2006 Main Street
Reconstruction Project. Construction is tentatively scheduled to last
until September 1, 2006. Businesses will remain open and access
maintained. Off-street parking is available in parking areas throughout
the downtown business area. The City appreciates the communitys
cooperation and encourages everyone to support our downtown businesses
during the construction.

Adjustments did review and approve the request for variance to
the minimum garage requirement to 1 car per unit and minimum

This decision was
issued after a determination was made that the variance for a reduction
in garage requirement and setback area would be in full compliance
with the Variance Review Criteria established within Buckley Municipal
Code (BMC) 19.40.030.
